End User License Agreement
In short: you may install and use the apps on your own devices to use the Service; you may not copy, resell or reverse-engineer them; everything else follows the Terms of Service.
Effective date: 12 October 2026
This agreement ("EULA") covers the Novagora apps for iOS and Android (the "App") as software. It is concluded between you and the operator of Novagora named in the Impressum ("Novagora", "we"). The Terms of Service govern the Service the App gives you access to, including your account, content, purchases, moderation, liability and disputes, and apply wherever this EULA is silent. The Privacy Policy covers personal data. By installing or using the App you accept this EULA.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, through the store you got it from, to use the Service under the Terms of Service. The App is licensed, not sold.
2. What you may not do
You may not copy the App beyond what the store permits, modify it or create derivative works, distribute, sell, rent, lend or sublicense it, remove proprietary notices, use it to build a competing product, or reverse engineer, decompile or disassemble it, except where the law expressly allows it (for example for interoperability under §§ 69d and 69e of the German Copyright Act).
3. Updates
We release updates that fix problems, improve security and add features. Some are required to keep using the Service, because App and Service change together, and the App may update automatically depending on your device settings. We support the operating system versions the store listing states; older versions may stop working.
4. Purchases
Plans and credit packs are in-app purchases sold by Apple or Google under section 7 of the Terms of Service. Credits have no cash value and are forfeited when your account is deleted or terminated for a violation. Prices and what you get are shown before you confirm.
5. Permissions
The App asks for a permission only when a feature needs it: notifications, the photo library to attach images and videos and save the ones you choose, and the microphone for voice notes. You can grant or revoke each in your device settings, and the rest of the App keeps working. Location and camera metadata is removed from images before upload.
6. If you got the App from the Apple App Store
For the matters they cover, these terms prevail over the rest of this EULA:
- This EULA is between you and Novagora only, not Apple Inc. or its subsidiaries ("Apple"). Novagora, not Apple, is solely responsible for the App and its content.
- Your use of the App must comply with the App Store's terms, including the usage rules in Apple's Media Services Terms.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to an applicable warranty, you may notify Apple, which will refund the App's purchase price, if any. To the extent the law permits, Apple has no other warranty obligation for the App, and any other claims, losses, liabilities, damages, costs or expenses from a failure to conform are Novagora's responsibility.
- Novagora, not Apple, handles any claim by you or a third party about the App or its possession or use, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar law.
- If a third party claims that the App or your possession and use of it infringes their intellectual property rights, Novagora, not Apple, is responsible for investigating, defending, settling and discharging the claim.
- You confirm that you are not in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the App, such as your wireless data service agreement.
- Apple and its subsidiaries are third-party beneficiaries of this EULA and, once you accept it, have the right (and are deemed to have accepted the right) to enforce it against you.
- Questions, complaints and claims about the App go to Novagora at the address in section 10, not to Apple.
7. If you got the App from Google Play
The Google Play Terms of Service also apply. Google is not a party to this EULA, gives no warranty for the App beyond what the law requires and is not responsible for it. Support, warranty and liability for the App are Novagora's, through section 10.
8. Term and termination
This EULA applies while the App is installed. It ends automatically if you breach it, if your account is terminated under the Terms of Service or if you uninstall the App; you must then stop using the App and delete every copy. Sections 2, 6.9 and 9 continue to apply.
9. Liability, consumer rights, law and changes
Liability, availability, governing law and changes follow sections 11, 13 and 14 of the Terms of Service. Nothing in this EULA limits your mandatory rights as a consumer under the law of the country where you live; where a provision conflicts with such a right, the right prevails.
10. Contact
[email protected], for questions, complaints and claims about the App.
